1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Infinee s. r. o. ("Company," "we," "us," or "our") concerning your access to and use of the SkySnail website (skysnail.io) and all related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

2. Description of Service

SkySnail is an AI-powered thumbnail generation platform designed for content creators. Our Service includes:

• AI-generated thumbnails for YouTube videos and social media content
• AI Editor for customizing and refining generated thumbnails
• Avatar creation and management for personalized thumbnails
• Video transcript access and AI-powered content summaries
• Template library for various content styles and niches
• Project management for organizing your thumbnail creations

3. Account Registration

To use certain features of the Service, you must create an account. By creating an account, you agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access
• Be at least 16 years of age

We use Google OAuth for secure authentication. By registering, you also agree to Google's Terms of Service and Privacy Policy.

4. Subscription Plans and Pricing

We offer the following subscription tiers:

All prices are in USD and exclude applicable taxes. Credits do not roll over to the next billing period and expire at the end of each billing cycle.

5. Payment and Billing

By subscribing to a paid plan, you agree to:

• Pay all fees associated with your selected plan
• Provide valid payment information through our payment processor (Stripe)
• Authorize automatic recurring charges according to your billing cycle

Billing Cycle: Subscriptions are billed in advance on a monthly or annual basis depending on your selected plan.

Price Changes: We reserve the right to change our prices. Any price changes will be communicated in advance and will take effect at the start of your next billing cycle.

6. Cancellation and Refunds

Cancellation: You may cancel your subscription at any time through your account settings. Upon cancellation:

• You will retain access to paid features until the end of your current billing period
• No further charges will be made after the current period ends
• Your account will revert to the Free plan

Refunds: We generally do not provide refunds for partial billing periods. However, if you believe you are entitled to a refund due to technical issues or service failures, please contact us at info@skysnail.io within 14 days of the charge.

EU Consumers: If you are a consumer in the European Union, you have the right to withdraw from your subscription within 14 days of purchase without giving any reason. However, by using the Service and consuming credits during this period, you acknowledge that you may lose your right to withdrawal for the services already rendered.

7. Acceptable Use

You agree not to use the Service to:

• Upload or generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Create thumbnails for content that promotes violence, hate speech, or discrimination
• Infringe on intellectual property rights of others
• Generate deceptive or misleading content (clickbait that misrepresents video content)
• Create adult or sexually explicit content
• Impersonate any person or entity
• Attempt to gain unauthorized access to our systems
• Use automated tools or bots to access the Service
• Resell or redistribute the Service without authorization

We reserve the right to suspend or terminate accounts that violate these policies.

8. Intellectual Property

8.1 Our Intellectual Property

The Service, including its original content, features, and functionality, is owned by Infinee s. r. o. and is protected by international copyright, trademark, and other intellectual property laws.

8.2 Your Content

You retain ownership of the images and content you upload. By uploading content, you grant us a limited license to process and store your content for the purpose of providing the Service.

8.3 Generated Thumbnails

Thumbnails generated using the Service are licensed to you for commercial and personal use. You may use generated thumbnails on YouTube, social media, and other platforms without attribution. However, you may not claim copyright over AI-generated portions of the thumbnails or use them in a way that violates these Terms.

9. AI-Generated Content Disclaimer

Our Service uses artificial intelligence to generate thumbnails. You acknowledge that:

• AI-generated content may not always meet your expectations
• Generated results may vary and are not guaranteed to be unique
• You are responsible for reviewing generated content before use
• We are not liable for how you use AI-generated thumbnails

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
• We do not guarantee uninterrupted or error-free operation
• We shall not be liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim

These limitations do not apply to the extent prohibited by applicable law, particularly consumer protection laws in the European Union.

11. Indemnification

You agree to defend, indemnify, and hold harmless Infinee s. r. o. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Service Modifications and Termination

We reserve the right to:

• Modify, suspend, or discontinue the Service at any time
• Change features, pricing, or availability with reasonable notice
• Terminate accounts for violations of these Terms

We will provide reasonable notice of significant changes when possible.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Slovakia, without regard to conflict of law principles.

EU Consumers: If you are a consumer in the European Union, you may also benefit from any mandatory provisions of the law of your country of residence. You have the right to bring proceedings in the courts of your country of residence.

14. Changes to Terms

We may revise these Terms at any time. Material changes will be notified via email or through the Service at least 30 days before taking effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
